Cress-examined by A. G.

I took the Photos on February 28th. A man was sent by

the solicitor and I was instructed what views to take. I did

net take any views on the West side,

James Charles West

Chief Warder in Victoria Gaol. On Saturday last an

identification parade was held in presence of Mr.Franke,

Superintendent. I was present. It was held at the instance of

Mr.Brutton. He desired the prisoner should be placed on pur-

pose of parade for identification. A line of 14 men was

paraded

men taken at random from remand department. Prisoner

to put on a black jacket to look in dress as much like the

others as possible. Prisoner then told to take any position

he liked. He took No.5 from the right. Hr. Brutton and others

were inside other people outside. Mr.Brutton called in his

clerk. He told him to call in the first witness. He came in

through the door. The man identified the prisoner at once walked up the line. Identification parades are usually done by Police themselves. There was no communication that I sew

between Mr.Brutton or his clerk.

He was then taken into a room so he could not communicate.

Another witness was called in and he went down the line and

at once identified the prisoner.

To the Jury

It is customary for a person to be allowed to place

himself in the line.
